Short Summary Why is there a need for development to talk about sexual orientation? All over the world lesbians and gay men suffer sexual identity-based discrimination in legal, social and cultural arenas. The role of law in upholding ‘morality’ has significant consequences in the case of sexuality when legislation can impinge on the right to be free from discrimination. This paper shows how the human rights approach to development which sets universal standards can be used by sexual minorities to claim equality and freedom from discrimination. The document provides valuable lobbying points such as how the role of law is there to protect the vulnerable and not prevent actions that do no harm. Concrete examples are given of the use of different clauses of treaties and covenants such as the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights, the African charter and the Convention on the Elimination of all forms of Discrimination Against Women (CEDAW).
